According to news reports, Donald Trump, Hillary Clinton, and Joe Biden were found to have not returned all secret government to the National Archives as required by law. Of the three, it appears that only Donald Trump will be/have been charged. Why? ..... Case facts.
When listening to the news or reading about legal cases, it is easy to perform quick comparisons. For example, why aren't Hillary Clinton and Joe Biden not charged with retaining documents while Donald Trump is? It's not fair to Trump. There's a government or democratic conspiracy.
We cannot give in to emotion. This may be politically expedient. However, emotions are irrelevant in legal proceedings. Only the case facts matter.
It appears that both Clinton and Biden each allowed law enforcement to perform their searches and retrieve all documents. There was no objection, no foot dragging, and no document movement.
However, according to reports and case filings, Trump claimed that all secret documents in his boxes at Mar-a-Lago were his. He delayed providing documents back to the National Archives. Trump had Mar-a-Lago employees hide secret documents from his attorneys who were tasked with finding and returning the documents. Trump also showed a top secrete document to people without clearance. When Trump learned that there were security videos showing his Club employees moving boxes with secret documents, he tried to have the security tapes erased.
Simply speaking, Clinton and Biden allowed assigned agents to locate and retrieve document; Trump did not.
There is no democrat conspiracy. There is no DOJ conspiracy against republicans or Trump. There are simply actions and case facts.
This is why I started this blog post with the John Adams quote.
