Tillman & Blackman Amicus Curiae Brief
The Baude & Paulsen and Heilpern & Worley research papers both indicate that Donald Trump is disqualified from running for president in November 2024 based on the language of Article 3 of the 14th Amendment.
However, Seth Barrett Tillman of Maynooth University School of Law and Criminology in Ireland and Josh Blackman of South Texas College of Law have written multiple law review articles stating that president is not an “officer of the United States”. They also argued the same point in an amicus curiae (friend of the court) brief to the Supreme Court in Trump v. Anderson, the Colorado case now before the justices.
I located and uploaded the amicus curiae brief to provide an opposing opinion.
The research by Tillman and Blackman is discussed and refuted within an article by Roger Parloff written on January 24, 2024 entitled
What Justice Scalia Thought About Whether Presidents Are “Officers of the United States”.
